1. Overview

These Terms of Service ("Terms") govern your access to and use of ImageZ, available at image-z.com, including our website, applications, AI image and video tools, generated assets, and related services (collectively, the "Service").

By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you use ImageZ on behalf of a company, team, or other organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and Accounts

To use the Service, you must be legally able to enter into a binding agreement under applicable law. You must provide accurate account information and keep it updated.

You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activity that occurs under your account
  • promptly notifying us of any unauthorized access or suspected security incident

We may require email verification or additional identity or payment checks in some situations.

3. What ImageZ Provides

ImageZ is an AI creative workspace for visual production. Depending on the plan, configuration, and feature availability, the Service may include:

  • AI image generation
  • image-to-image editing and variation workflows
  • background removal and related image editing tools
  • upscale and output refinement workflows
  • image-to-video and other AI video generation workflows
  • credit-based usage, subscriptions, asset storage, and task history

We may add, remove, improve, limit, or discontinue features at any time.

4. Plans, Credits, Billing, and Asset Retention

ImageZ offers paid plans, including plan tiers such as Basic, Standard, Pro, and Ultra, in monthly or annual billing options. Plan details shown on the pricing page at the time of purchase are part of these Terms.

Credits

  • Most generation and editing actions consume credits.
  • Credit usage depends on the selected workflow, model, output settings, resolution, duration, and other parameters.
  • Credits have no cash value, are not property, and are not transferable unless we explicitly allow it.
  • We may offer promotional, trial, bonus, or goodwill credits. Those credits may have separate rules, expiration dates, or limitations.

Subscription Cycles

  • Monthly plans generally provide the included credits on a monthly cycle.
  • Annual plans do not issue the full year's credits upfront. Included credits are generally issued on a rolling 30-day cycle during the subscription term.
  • Subscriptions may renew automatically unless canceled before the next billing date, subject to the terms presented at checkout and the rules of the payment processor.

Asset Retention

Generated or processed assets are retained based on your active plan unless deleted earlier by you, removed for policy or legal reasons, or lost due to events outside our reasonable control. Current standard retention periods are:

  • Basic: 7 days
  • Standard: 15 days
  • Pro: 30 days
  • Ultra: 90 days

You are responsible for exporting and backing up assets you want to keep.

Pricing and Payment

  • Prices are listed in the currency shown at checkout.
  • You authorize us and our payment processors to charge the selected payment method for subscriptions, renewals, taxes, and any other applicable fees.
  • Payments may be processed by third parties such as Stripe, Creem, PayPal, or other providers we make available.
  • We may change prices or plan features for future billing periods or future purchases.

5. Refunds and Cancellations

Unless otherwise required by law, approved in writing by ImageZ, or stated differently at checkout:

  • subscription and plan purchases are generally non-refundable after the applicable refund window
  • you may request a refund within 3 days of purchase if you have used no more than 5% of the included credits or 100 credits, whichever is lower
  • refund requests are reviewed manually
  • large-scale usage, abuse, fraud, chargebacks, repeated refund activity, or policy violations are not eligible for refunds
  • taxes, government charges, currency conversion losses, and non-refundable payment processing fees may be excluded from any refund where permitted by law

If you cancel a subscription, the cancellation generally takes effect at the end of the current billing period unless the payment processor or applicable law requires otherwise. Canceling stops future renewals but does not retroactively refund prior charges.

6. User Content and AI Outputs

Your Content

You may submit prompts, text, reference files, images, videos, and other materials to the Service ("Input"). The Service may return generated or transformed images, videos, text, or related assets ("Output"). Input and Output together are "User Content."

As between you and ImageZ, and to the extent permitted by law:

  • you retain your rights in your Input
  • you are responsible for ensuring you have all rights, licenses, permissions, and consents needed to submit your Input and use your Output

You grant ImageZ a worldwide, non-exclusive license to host, copy, transmit, store, display, modify, and process User Content as necessary to operate, secure, improve, and support the Service.

AI-Specific Terms

  • Outputs may not be unique.
  • Other users may receive similar or identical results.
  • You must review Outputs before publishing, selling, relying on, or distributing them.
  • You are solely responsible for how you use Inputs and Outputs, including compliance with intellectual property, privacy, publicity, advertising, platform, and other applicable laws.

7. Acceptable Use

You may not use the Service to:

  • violate any law or regulation
  • infringe, misappropriate, or violate any intellectual property, privacy, publicity, or other rights
  • create, upload, or distribute unlawful, abusive, harassing, hateful, defamatory, fraudulent, sexually exploitative, or violent content
  • impersonate others or create deceptive or harmful deepfakes, scams, or disinformation
  • upload malware, attempt unauthorized access, probe vulnerabilities, interfere with the Service, or bypass usage limits
  • scrape, resell, sublicense, or exploit the Service in an unauthorized way
  • use the Service to train competing models or build a competing service using our outputs, software, workflows, or infrastructure except where we expressly permit it

We may investigate violations and suspend or remove accounts, content, tasks, or assets at our discretion.

8. Intellectual Property

The Service, including our software, design, branding, interfaces, workflows, documentation, and site content, is owned by ImageZ or our licensors and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. No other rights are granted.

If you provide feedback or suggestions, we may use them without restriction or compensation.

9. Third-Party Services

ImageZ may rely on third-party providers for authentication, payment processing, analytics, storage, communications, and AI inference. Your use of those integrated services may also be subject to the third party's terms or privacy practices.

We are not responsible for third-party services, websites, outages, policies, or actions.

10. Service Availability and Changes

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or that every feature or model will remain available.

We may:

  • update, improve, or remove features
  • change model availability, limits, pricing, or usage rules
  • impose rate limits, batch limits, storage limits, or account verification requirements
  • perform maintenance that temporarily affects availability

11. Suspension and Termination

We may suspend, restrict, or terminate access to the Service immediately if we reasonably believe:

  • you violated these Terms or our policies
  • your use creates legal, security, fraud, abuse, or payment risk
  • we are required to do so by law or a service provider

You may stop using the Service at any time. Account deletion or termination may result in loss of access to User Content, credits, subscriptions, task history, and stored assets, subject to our retention obligations.

12. Disclaimers

To the fullest extent permitted by law:

  • the Service and all Outputs are provided "as is" and "as available"
  • we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy
  • we do not guarantee that Outputs will be lawful, accurate, original, commercially usable, or suitable for any specific purpose

13. Limitation of Liability

To the fullest extent permitted by law, ImageZ and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, business, goodwill, data, or opportunities arising out of or related to the Service.

Our aggregate liability for all claims arising out of or related to the Service will not exceed the greater of:

  • the amount you paid to ImageZ for the Service in the 12 months before the event giving rise to the claim, or
  • USD $100

Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will become effective when posted on the Service unless we state otherwise. Your continued use of ImageZ after the effective date of the updated Terms means you accept the revised Terms.
